An Agreement to Hire Rental Vehicle (“Agreement”) made between Nomad Campervans Limited (“Nomad Campervans”) and the hirer whose particulars are entered in this Agreement (the “Hirer”). It is hereby agreed as follows:
Nomad Campervans will let and the Hirer will take on hire the motor vehicle described in this Agreement.
The term of the hire shall be for the period as described in this Agreement
The vehicle may be driven during the period of hire only by the persons described in this Agreement and only if each such person holds a current driver’s licence (particulars of which are given alongside his/her name and address) appropriate for the vehicle at the time when they are driving the vehicle.
Prior to collection of the vehicle, the Hirer shall pay to Nomad Campervans all fees in full for the hire of the vehicle for the period of hire referred to in this Agreement.
a) The Hirer shall pay to Nomad Campervans the sum specified in this agreement for the insurance cover and bond set out in this Agreement.
b) In addition to the payment specified in clause 4 of this Agreement, the Hirer shall pay Nomad Campervans on termination of the hiring, a distance charge at the rate referred to as Road User Charges in this Agreement.
c) The Hirer shall pay for ALL PETROL OR OTHER FUEL (but not oil) used in the vehicle during the period of the hire.
The Hirer is liable for NZD $6.70 per 100 kilometres travelled for all diesel vehicles. Road User Charges will be calculated at the end of the hire and are payable to the Operator. The Hirer having received the vehicle in a clean condition with a full fuel tank, full bottle of gas and empty holding tanks for grey water and black water (toilet cassette) will return the vehicle on the date, time and the return location set out in the Agreement:
Nomad Campervans may charge the Hirer a cleaning fee of up to $250 NZD if, in the reasonable opinion of Nomad Campervans, the vehicle is not returned in a clean and tidy condition.
Nomad Campervans may charge the Hirer a fee of up to $500 NZD for failure to empty the grey water or black water(toilet cassette) from the vehicle.
The Hirer shall ensure that:
The Hirer is liable for all damages to the vehicle regardless of who is at fault. If the Hirer is not at fault and a third party admits liability, then a refund will be processed upon receipt of payment from the third party.
Insurance does not cover the Hirer’s personal belongings. The Hirer or Hirers are responsible for their own property and will require adequate travel insurance to cover medical expenses, personal effects, travel cancellation.
The Hirer may choose Kick Start, Over the Hump or Piece of Mind options for Excess Reduction Cover coverage of the vehicle.
Standard Insurance is included in the rental rate. To hire a Nomad Campervan, there is an excess of $2000 NZD for drivers over 25 years ($2500 NZD for drivers 18-24 years, GST included) for any single vehicle accident. To hire a Nomad Campervan Motorhome there is an excess of $5000 NZD for drivers over 25 years ($6000 NZD for drivers 21-24 years, GST included) for any single vehicle accident. Note: This is a basic cover and does not cover glass, windscreen or tyre damage.
Nomad Campervans offer three levels of Excess Reduction Options over the Standard Insurance.
Campervan Excess Reduction Options:
The Hirer can pay an additional $25 NZD per day to a maximum of fifty rental days to reduce the excess to $1500 for drivers over 25 years ($2000 NZD for drivers 18-24 years, GST included) for any single vehicle accident and NIL excess for windscreen and tyre damage (excludes service for changing a tyre).
The Hirer can pay an additional $30 NZD per day to a maximum of fifty rental days to reduce the excess to $1000 NZD for drivers over 25 years ($1500 NZD for drivers 18-24 years, GST included) for any single vehicle accident and NIL excess for windscreen and tyre damage (excludes service for changing a tyre).
The Hirer can pay an additional $35 NZD per day to a maximum of fifty rental days to reduce the excess to $250 NZD for drivers over 25 years ($500 NZD for drivers 18-24 years, GST included) for any single vehicle accident and NIL excess for windscreen and tyre damage (excludes service for changing a tyre).
Motorhome Excess Reduction Options:
The Hirer can pay an additional $30 NZD per day to a maximum of fifty rental days to reduce the excess to $1500 for drivers over 25 years ($2000 NZD for drivers 18-24 years, GST included) for any single vehicle accident and NIL excess for windscreen and tyre damage (excludes service for changing a tyre).
The Hirer can pay an additional $35 NZD per day to a maximum of fifty rental days to reduce the excess to $1000 NZD for drivers over 25 years ($1500 NZD for drivers 18-24 years, GST included) for any single vehicle accident and NIL excess for windscreen and tyre damage (excludes service for changing a tyre).
The Hirer can pay an additional $40 NZD per day to a maximum of fifty rental days to reduce the excess to $250 NZD for drivers over 25 years ($500 NZD for drivers 18-24 years, GST included) for any single vehicle accident and NIL excess for windscreen and tyre damage (excludes service for changing a tyre).
a) The Hirer has the option of purchasing a daily Excess Reduction Option to reduce the Standard Excess payable by the Hirer.
b) The Hirer’s liability applies to each seperate accident/damage or loss – not each hire.
c) If the Hirer elects to not use Excess Reduction Option Cover, the excess payable by the Hirer is the Standard Insurance Excess as stated in the Agreement and is payable for each and every event involving the vehicle.
The Hirer is at all times fully liable for all fees, damages, expenses and costs associated with the relevant event. Excess Reduction Options SHALL NOT APPLY to damages, expenses or costs arising from the exclusions set out below:
a) The driver of the vehicle is under the influence of alcohol or any drug that affects his/her ability to drive the vehicle.
b) The vehicle is in an unsafe or unroadworthy condition that arose during the course of the hire and that caused or contributed to the damage or loss, and the Hirer or authorised driver was aware or ought to have been aware of the unsafe or unroadworthy condition of the vehicle.
c) The vehicle is driven by any person not recorded as an authorised driver in the Agreement.
d) The vehicle is damaged as a result of water submersion from crossing rivers, creeks, salt water or driving on beaches.
e) The vehicle is operated in any race, speed test, rally, contest or off-road conditions including beaches, sand tracks and paddocks.
f) The Hirer does not obey height-restricted areas and damage is caused to the roof of the vehicle.
g) The Hirer continues to drive the vehicle when a warning light appears or when the engine temperature gauge is over the normal engine operating temperature.
h) The costs to replace keys which have been lost, broken or damaged, the cost of retrieval of keys that have been locked inside the vehicle.
i) Any costs associated with the the incorrect use of fuel or contamination of the vehicle fuel.
j) The vehicle is wilfully or recklessly damaged by the Hirer or any authorised driver or driving under the authority of the Hirer, or is lost as a result of the wilful or reckless behaviour of the Hirer or any such person.
k) The Hirer is involved in a single vehicle rollover or the roof of the vehicle is damaged as a result of any single vehicle incident or accident. This includes a vehicle that has rolled, tipped or fallen onto its side resulting in damage to the roof and/or sides of the vehicle. Regardless of Excess Reduction Options chosen by the Hirer,
the Hirer is responsible for damage costs up to the Standard Insurance Excess. Damage costs are payable to Nomad Campervans.
l) The vehicle is driven by any person who at the time when he/she drives the vehicle is disqualified from holding or never held a driver’s license appropriate for that vehicle.
m) The vehicle can be operated on gravel roads. However, driving on gravel or unsealed roads voids all liability limitations and cover.
n) The vehicle is operated on any of the following roads: Skippers Canyon (Queenstown), Ball Hutt Road (Mount Cook), Ninety Mile Beach (Northland) or any river or beach.
o) The vehicle is operated outside the term of the hire or any agreed extension of that term.
p) All costs as a result of breakages, loss, theft or defacement of the vehicle’s interior and accessories caused or contributed to by the Hirer, any authorised driver, any person that the Hirer permits or allows to drive the vehicle, any invitee of the Hirer or any passenger in the vehicle.
q) It is agreed between Nomad Campervans and the Hirer that section 11 of the Insurance Law Reform Act 1977 shall apply in respect of the above exclusions as if this clause constituted a contract of insurance.
a) The Hirer agrees to pay a bond equal to the applicable insurance excess specified in the Agreement to Hire Rental Vehicle. On payment of a Excess Reduction Cover option by the Hirer, the bond payable by the Hirer is reduced to $500 NZD. The Bond is payable by credit card only. Please note the relevant amount will be debited from the Hirer’s credit card immediately on vehicle collection. The Bond is fully refundable provided the vehicle is returned on time on the return date and to the return location undamaged. The vehicle must be clean and with a full fuel tank, full gas bottle and empty grey and black water(toilet cassette) tanks.
b) The Hirer authorises Nomad Campervans to deduct from the Bond the amounts of charges or damages due by the Hirer to Nomad Campervans arising as a result of this agreement. Nomad Campervans will notify the Hirer by contacting them at the email address specified in the Agreement of the deduction of such amounts.
c) Third Party Insurance is not compulsory in New Zealand. There is no guarantee that damages will be recovered from another party involved in an incident with the Hirer. Hence, where a third party causes damage, the Hirer is liable for damages as specified in their Agreement to Hire Rental Vehicle. If the amount of damages cannot be recovered from the third party, the Hirer’s Bond may not be refunded.
a) Nomad Campervans shall supply the vehicle in a safe and roadworthy condition, up to the current Certificate of Fitness standards.
b) Nomad Campervans shall be responsible for all ordinary and extraordinary costs of running the vehicle during the term of the hire except to the extent that by the terms of this agreement those costs are payable by the Hirer. The cost of petrol and other fuel, but not oil, used during the term of the hire is the responsibility of the Hirer.
c) If the reserved vehicle is not available for reasons outside Nomad Campervans control, then the reserved vehicle may be substituted with a comparable or superior vehicle at no extra cost to the Hirer. A substitute vehicle shall not constitute a breach of contract and does not entitle the Hirer to any form of refund. If no substitute vehicle is available to the Hirer, Nomad Campervans liability shall be limited to a refund of the hire charge in full. In the case of mechanical failure (unless caused by the Hirer) Nomad Campervans liability shall be limited to the hire charge remainder of the term of hire.
a) If the vehicle is damaged or requires repair or salvage, whether because of an accident or breakdown, the Hirer shall advise the owner of the full circumstances by telephone within 24 hours.
b) The Hirer shall not arrange or undertake any repairs or salvage without the authority of the owner except to the extent that the repairs and salvage are necessary to prevent further damage to the vehicle or to other property. If the vehicle is damaged to the extent that it cannot be driven, Nomad Campervans shall endeavour to exchange the vehicle. Provisioning of a replacement vehicle is subject to availability and Hirer’s location.
c) Nomad Campervans liability extends only to the refund of hire charges for any full days of vehicle use lost due to a mechanical breakdown. No responsibility for out of pocket expenses, accommodation or meals charges resulting from a breakdown or accident will be accepted.
The Hirer Shall Not:
a) Use or permit the vehicle to be used for the carriage of passengers for hire or rewards unless the vehicle is hired with the knowledge of the owner for use in a passenger service licensed under Part-1 of the Transport Services Licensing Act 1989.
b) Sublet or Hire the vehicle to any other person.
c) Permit the vehicle to be operated outside his/her authority or operate the vehicle or permit it to be operated in any race, speed test, rally or contest.
d) Operate the vehicle, or permit it to be operated, in circumstances that constitute an offence by the driver against Section 58 of the Transport Act 1962 (which relates to driving with excess breath or blood alcohol or under the influence of drink or drugs).
e) Operate the vehicle or permit it to be operated in breach of the Transport Act 1962, the Traffic Regulations 1976, or any other ACT, regulations, or bylaws to road traffic.
f) Operate the vehicle or permit it to be operated for the transport of more than the number of passengers or more than the weight of goods specified in the certificate of loading.
g) Drive or permit the vehicle to be driven by any person if at the time of driving the vehicle, the Hirer or other person is not the holder of a current driver’s licence appropriate for the vehicle.
The Hirer shall, at or before the expiry of term of hire deliver the vehicle to Nomad Campervans place of business or Nomad Campervans agent at the place of business as shown on the Agreement, or obtain Nomad Campervans consent to the continuation of hire.
All traffic offences and fines (including speeding,parking,freedom camping and toll road notices) are the liability of the Hirer. If Nomad Campervans receives notice of an infringement and/or fine you will be notified by email and provided with a copy of the infringement or fine as soon as practical after it is received by Nomad Campervans. After notification the following may occur.
a) Nomad Campervans will transfer the infringement and/or fine into the Hirer’s name and charge an administration fee of $50 for each infringement and/or fine: or
b) Debit the Hirer’s credit card for the amount of the infringement and/or fine and charge an administration fee of $50 for each infringement and/or fine.
The Hirer may have the right to challenge, query or object to the alleged offence. Note: Any challenge, objection or query of an offence(s) must be made to the issuing authority, not Nomad Campervans.
Nomad Campervans shall have the right to terminate the hire and take immediate possession of the vehicle if the Hirer fails to comply with any of the terms of this agreement, or if the vehicle is damaged. The termination of the hiring under the authority of this clause shall be without prejudice to the other rights of the owner and the rights of the Hirer under this agreement or other wise.
Cancellation Policy applies unless other arrangements are negotiated between NOMAD Campervans and the Hirer.

All Nomad Campervan vehicles are registered with the Automobile Association (AA) for 24-hour roadside assistance. This service covers any mechanical faults with the vehicle. The AA does not cover the following and the associated costs will be the responsibility of the Hirer:
a) The vehicle running out of fuel or a breakdown as a result of the vehicle being incorrectly fuelled.
b) The vehicle is unable to be accessed due to a lockout or the vehicle keys being lost.
c) Flat batteries caused by incorrect usage of the batteries and/or incorrect use of any equipment that requires the batteries in order to operate.
d) Flat or damaged tyres (applicable only to an Agreement with Standard Insurance) Tyre damage is covered if a Hirer has purchased Excess Reduction Insurance.
e) The vehicle is unattended at the time the AA Service Provider arrives at the breakdown location.
f) The vehicle is not on public or formed road or is trapped or bogged.
g) Non-mechanical call-outs to the AA will incur a call-out charge.
The Hirer release Nomad Campervans and its employees and agents from any liability to the Hirer (regardless of who is at fault) for any loss or damage incurred by the Hirer by reason of rental, possession or use of the vehicle or storage of personal belongings at the Nomad Campervans premises.
